Dinetap App terms

Last updated 26 October 2026 Applies to people using the Dinetap App in Australia

Draft for legal review. Prepared for Dinetap Australia Pty Ltd and not yet approved. Highlighted items are still to be confirmed. These are the terms for the Dinetap App. If you run a restaurant on Dinetap, the merchant terms apply to you.

These terms apply when you use the Dinetap app in Australia. The app is provided by Dinetap Holdings Pte. Ltd., 11 Keng Cheow Street, #02-11, The Riverside Piazza, Singapore 059608 (“Dinetap”, “we”, “us”).

By creating an account or using the app you agree to these terms. Please read them, together with our privacy policy.

1. Your rights under Australian Consumer Law

Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or changed. Where these terms limit our responsibility, they do so only as far as the law allows.

2. What the Dinetap app does

The Dinetap app helps you find restaurants, cafés and other places to eat. You can search by area, cuisine, dietary preference and other filters, and view restaurant details, menus, photos, opening hours, ratings and offers.

Restaurants run their own businesses. They, not Dinetap, prepare and sell food and drink and provide dining services, and they are responsible for them. The current version of the app is for discovery only: you cannot order, book or pay through it. If we add features such as ordering, prepayment or cashback, we will tell you about any extra terms before you can use them.

The app is free. We may change, add or remove features over time. If we remove a significant feature, we will try to tell you in advance.

3. Who can use the app and your account

You must be at least [16] years old to create an account. If you are under 18, you should have your parent or guardian’s permission.

You can sign up with an email address or with Google or Apple. Please give accurate details, keep your login secure and tell us straight away if you think someone else has used your account. You are responsible for what happens in your account unless it is caused by our failure to keep the app secure.

You can delete your account at any time in the app or by following the steps on our delete account page.

4. Restaurant information

Restaurant information comes from restaurants, from Google and from other sources. It can change without notice and may sometimes be wrong, out of date or incomplete. We work to keep it accurate, but we do not check every detail.

Please confirm important details with the restaurant before you go, including opening hours, prices, menu items, offers and booking requirements.

Allergies and dietary needs. Dietary labels and filters are a guide only, based on what restaurants tell us. If you have an allergy or medical dietary need, always check directly with the restaurant before you order.

Offers shown in the app are made by restaurants and are subject to the restaurant’s own conditions.

5. Ratings, reviews and maps

Some ratings and reviews come from Google and are shown with Google’s attribution. They reflect the views of the people who wrote them, not Dinetap’s views, and we do not change them. Map and place features are provided by Google Maps Platform, and your use of them is also subject to the Google Maps terms.

Distances and walking times are estimates. Restaurants cannot pay to remove genuine reviews. No listings are paid or promoted. If that changes, paid listings will be labelled “Sponsored”.

6. Location

The app works best when you share your location, so it can show places near you. Sharing your location is optional: you can turn it off in your device settings and choose an area yourself instead. Our privacy policy explains how we handle location information.

7. Photos and other content you post

You may be able to upload photos and other content (“your content”). You keep ownership of your content.

By uploading it, you give Dinetap a non-exclusive, worldwide, royalty-free licence to host, store, copy, display, resize and crop your content, and to show it in the app and on our website and social media for the purpose of running and promoting Dinetap. This licence ends when you or we delete the content, except for copies already shared under this licence and backup copies kept for a limited time.

You consent to us resizing or cropping your content and showing it without naming you as the author, which might otherwise infringe your moral rights under the Copyright Act 1968 (Cth).

You promise that you own your content or have permission to post it, that anyone identifiable in it has agreed, and that it follows the rules in section 8.

We may review, refuse or remove content that breaks these terms or the law, or that someone reports to us. We remove content based on these rules, not because it is negative about a restaurant.

8. Rules for using the app

You must not:

  • post content that is unlawful, false or misleading, defamatory, harassing, hateful, sexually explicit, violent or otherwise objectionable;
  • post content that infringes someone else’s copyright, privacy or other rights;
  • post photos of people without their consent, or personal information about others;
  • post fake reviews or content you have been paid or rewarded for without saying so;
  • impersonate anyone, or misrepresent your connection with a restaurant;
  • scrape, copy or harvest data from the app, or use bots or automated tools;
  • interfere with the app’s security, reverse engineer it, or try to access it in ways we have not made available; or
  • use the app for any unlawful purpose.

9. Reporting content and copyright complaints

You can report content or another user in the app, or by emailing support@dinetap.com. We aim to review reports promptly and within 2 business days.

If you believe content in the app infringes your copyright, email us with: your name and contact details; a description of the work and where the content appears in the app; a statement that you own the copyright or are authorised to act for the owner; and a statement that the information in your notice is accurate. We will remove or disable access to content that appears to infringe, and tell the person who posted it, who may respond.

10. Our intellectual property

The app, our brand and the content we create belong to Dinetap or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use, in line with these terms. You must not copy, modify, sell or distribute the app or its content except as these terms allow.

If you send us ideas or feedback, we may use them without paying you or owing you anything.

11. Privacy

Our privacy policy explains how we collect, use and protect your personal information and how you can access or correct it.

12. Suspending or closing accounts

We may suspend or close your account, or remove your access to features, if you seriously or repeatedly break these terms, if we reasonably suspect fraud or unlawful use, or if we need to protect other users or the app. Where it is reasonable, we will tell you why and give you a chance to respond first.

We may stop providing the app in Australia. If we do, we will give you at least 30 days’ notice where we can.

13. Responsibility and liability

Section 1 applies to this section. We provide the app with due care and skill, but we cannot promise it will always be available, error-free or uninterrupted, or that restaurant information will always be accurate.

As far as the law allows, we are not responsible for:

  • the food, drink, service, prices, hygiene, allergen handling or conduct of any restaurant;
  • information supplied by restaurants, Google or other users; or
  • loss that was not reasonably foreseeable, or that was caused by your breach of these terms or by events outside our reasonable control.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.

14. If you break these terms

If you deliberately break these terms, or post content that infringes someone else’s rights, and that causes loss to Dinetap or a claim against us, you are responsible for the reasonable loss that results, to the extent you caused it.

15. Changes to these terms

We may update these terms to reflect changes to the app, our business or the law. We will publish the new version here with a new date. If a change is significant or could disadvantage you, we will tell you at least 30 days before it takes effect, by email or in the app. If you do not agree, you can stop using the app and delete your account.

16. Complaints and disputes

If something goes wrong, please contact us first at support@dinetap.com or on +61 403 111 317. We aim to respond within 10 business days.

If we cannot resolve it, you can contact your state or territory consumer protection agency, such as the Queensland Office of Fair Trading, or apply to a tribunal such as the Queensland Civil and Administrative Tribunal (QCAT). Privacy complaints can also go to the OAIC, as our privacy policy explains.

These terms are governed by the law of Queensland. You and we can bring proceedings in the courts of Queensland, and you keep any right you have to bring a claim in your own state or territory.

17. App Store and Google Play

If you downloaded the app from Apple’s App Store:

  • these terms are between you and Dinetap, not Apple, and Dinetap, not Apple, is responsible for the app and its content;
  • your licence to use the app is limited to Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms;
  • Apple has no obligation to provide maintenance or support for the app;
  • if the app fails to meet any applicable warranty, you may notify Apple, and Apple will refund any price you paid for it (the app is free). To the extent the law allows, Apple has no other warranty obligation for the app;
  • Dinetap, not Apple, is responsible for any claims about the app, including product liability claims, claims that the app does not meet a legal or regulatory requirement, and consumer protection, privacy or similar claims;
  • Dinetap, not Apple, is responsible for investigating, defending, settling and discharging any claim that the app infringes a third party’s intellectual property rights;
  • you confirm that you are not located in a country subject to a United States Government embargo or designated as a “terrorist supporting” country, and you are not on any United States Government list of prohibited or restricted parties;
  • you must comply with any third-party terms that apply when you use the app, for example your mobile data provider’s terms; and
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

If you downloaded the app from Google Play, Google’s terms of service also apply to your use of Google Play.

18. General

If any part of these terms is invalid or unenforceable, the rest continues to apply. If we do not enforce a right straight away, we can still enforce it later. You may not transfer your rights under these terms. We may transfer ours to a related company or to a buyer of our business, and will tell you if we do.
