Payment terminal terms

Last updated 26 October 2026 Applies to restaurants using a Dinetap payment terminal in Australia

Draft for legal review. Prepared for Dinetap Australia Pty Ltd and not yet approved. Highlighted items are still to be confirmed. These terms cover the payment terminal we supply. They are part of the merchant terms.

These terms apply when Dinetap Australia Pty Ltd (ABN 23 679 041 537, ACN 679 041 537) (“Dinetap”) supplies you with a payment terminal. They form part of your agreement with us under the merchant terms, which also apply.

1. Your terminal

We supply each approved merchant with a Castles S1F2 payment terminal with a built-in receipt printer, Wi-Fi and 4G mobile connectivity, and the Dinetap payments app (the “terminal”). The number of terminals is set out in your application.

There is no charge for one terminal per venue, its delivery by an Adyen-approved courier, setup or mobile data while your merchant agreement is in force. Additional terminals are available on request at A$500 each.

2. Who owns the terminal

The terminal remains the property of Dinetap. You may use it for your business while your merchant agreement is in force, but you must not sell, lend, rent out, pledge or give it away, or allow anyone to claim an interest in it.

We may register our interest in the terminal on the Personal Property Securities Register, and you agree to sign anything reasonably needed for that. [decide whether to register: legal advice on whether a free loan is a PPS lease]

3. Using the terminal

You must:

  • use the terminal only to accept payments for your own business, at your registered venue or as we have approved;
  • follow the setup and safety instructions we give you, keep the software up to date, and keep the terminal charged and connected;
  • make sure only your trained staff use it;
  • keep it reasonably safe from theft, damage, liquid, heat and tampering; and
  • keep enough receipt paper. Receipt paper is your cost unless we agree otherwise.

You must not open, modify, repair or reverse engineer the terminal, install other software on it, or use it in a way that breaches the card scheme rules or the law.

4. Faults and replacement

If the terminal stops working properly through no fault of yours, contact support on +61 403 111 317. We will try to fix it remotely, and otherwise replace it at no cost, aiming to dispatch a replacement within 1 business day of confirming the fault. Normal wear and tear is not your responsibility. This does not limit any guarantee you have under the Australian Consumer Law. Where the law allows, our liability for a faulty terminal is limited to repairing or replacing it.

5. Loss, theft and damage

Tell us immediately, and within 24 hours, if a terminal is lost, stolen or you suspect it has been tampered with, so we can disable it. Report thefts to the police and give us the report number.

You are responsible for loss, theft or damage caused by you, your staff or your contractors, or by failing to look after the terminal as section 3 requires. In that case we may charge you the cost of repair or replacement, up to A$500 per terminal. We will tell you the amount and the reason before we charge it.

6. Surcharges and settings

The terminal does not add card surcharges, in line with the Reserve Bank of Australia’s ban on card surcharges from 1 October 2026. You must not use it, or set it up, to charge customers more for paying by card.

Card surcharging is switched off on every terminal, and the terminal has no weekend or public holiday surcharge setting. You are responsible for the settings you choose, such as tipping options, and for displaying your prices as the law requires.

7. Receipts

The terminal can print and send receipts. You are responsible for giving customers receipts and tax invoices where the law requires. A printing failure does not cancel an approved payment.

8. Returning the terminal

When your merchant agreement ends, or if we replace a terminal, you must make it available for collection within 7 days. An Adyen-approved courier will pick it up at no cost to you. If you do not return it in that time, after a reminder, we may charge the replacement cost stated in section 5.

9. Security

The terminal is certified to the payment industry’s security standards (PCI PTS). Never write down card numbers or PINs, or ask customers for them. Tell us immediately about anything suspicious, such as a device you did not expect being attached to the terminal.
